Make it Lux Terms of Service

These Terms of Service ("Terms") govern your access to and use of Make it Lux, including our website, applications, AI content generation tools, Lux Credits, public gallery, discovery feed, and related services (together, the "Service").

By accessing or using the Service, creating an account, uploading content, purchasing or redeeming Lux Credits, or publishing content to public areas of the Service, you agree to these Terms, our Privacy Policy, our Credit and Refund Policy, our Cookie Notice, and our Community Guidelines.

If you do not agree, do not use the Service.

1. Who We Are

Make it Lux is operated from New South Wales, Australia.

In these Terms, "Make it Lux", "we", "us", and "our" means the operator of the Make it Lux Service.

2. Eligibility and Accounts

You must be at least 16 years old, or the minimum age required in your country to use online services of this kind, whichever is higher.

You must provide accurate account information and keep your login details secure. You are responsible for activity on your account unless caused by our breach of these Terms or applicable law.

You must not create accounts using false information, impersonate another person or business, create accounts for others without permission, or create multiple accounts to bypass limits, credits, promotional offers, moderation, security controls, or payment obligations.

3. What Make it Lux Provides

Make it Lux helps users create product campaign content from uploaded product photos and user direction. Features may include studio images, storyboards, cinematic ads, product videos, brand context, prompt assistance, public gallery posts, and discovery feed experiences.

The Service uses third-party systems and AI models. Outputs can be imperfect, inaccurate, unexpected, delayed, unavailable, or unsuitable for your intended use. You are responsible for reviewing outputs before publishing, advertising, selling, or relying on them.

4. Your Content

"Your Content" means anything you upload, submit, generate, publish, or otherwise make available through the Service. This includes product photos, brand assets, logos, prompts, directions, reference images, generated images, generated videos, captions, account information, and gallery posts.

You retain any rights you have in Your Content. We do not claim ownership of Your Content.

You confirm that:

  • you own Your Content or have all rights, permissions, and consents needed to use it with the Service;
  • Your Content does not infringe copyright, trade mark, privacy, publicity, moral rights, confidentiality, consumer protection, advertising, or other rights;
  • you have permission to upload photos or videos of people, private property, brand assets, logos, packaging, products, music, or other protected material where permission is required;
  • Your Content and your use of outputs comply with applicable laws and platform rules.

5. Licence for Private Content

For content you keep private, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transform, transmit, display, and create outputs from Your Content as needed to:

  • provide, operate, secure, and maintain the Service;
  • generate and deliver outputs you request;
  • troubleshoot, support, audit, and improve the Service;
  • comply with law, enforce these Terms, prevent abuse, and protect users.

We will not use your private uploads or private outputs in public marketing or the public gallery unless you publish them, feature them, or give us permission.

Third-party providers may process Your Content as needed to provide the Service. See our Privacy Policy for more detail.

6. Public Gallery and Discovery Feed

The Service may include public or semi-public areas, including a gallery, creator feed, examples, showcases, or featured content.

If you choose to publish, feature, submit, or make content public through the Service, you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, display, distribute, reproduce, crop, resize, format, edit for technical presentation, promote, and otherwise use that public content in connection with:

  • operating and improving the Service;
  • displaying the public gallery and discovery feed;
  • featuring examples and creator work;
  • marketing Make it Lux across our website, social media, emails, pitch materials, and other promotional channels.

This licence does not transfer ownership of Your Content to us.

You may ask us to remove public content by contacting support@makeitlux.com. We will take reasonable steps to remove it from active public display, but cached copies, backups, already-shared materials, and copies outside our control may persist for a reasonable period.

7. AI Inputs and Outputs

The Service processes your inputs, including prompts, directions, images, brand context, and reference material, to create outputs.

Subject to these Terms and applicable law, you may use outputs commercially. You are responsible for checking whether an output is suitable for your intended use, including product accuracy, claims, advertising compliance, third-party rights, likeness rights, and platform rules.

AI outputs may:

  • contain visual artifacts, distorted details, inaccurate text, or product inaccuracies;
  • resemble outputs generated for other users;
  • fail to preserve product, logo, label, or packaging details perfectly;
  • be unsuitable for regulated advertising or claims without further review;
  • require editing, iteration, or replacement.

We do not guarantee that any output is unique, legally protectable, registrable, accurate, non-infringing, or suitable for a specific commercial purpose.

8. Content Restrictions

You must comply with our Community Guidelines. You must not upload, generate, publish, request, or use content that is unlawful, infringing, deceptive, harmful, abusive, exploitative, hateful, sexually explicit involving minors, non-consensual, invasive of privacy, or otherwise prohibited by our policies.

We may refuse to process, remove, hide, moderate, or restrict content where we believe it may violate these Terms, our policies, applicable law, third-party rights, platform safety expectations, or our brand and community standards.

9. Payments, Subscriptions, Lux Credits, and Promotional Credits

Make it Lux may offer one-time packages, subscriptions, Lux Credit top-ups, promotional credits, or other paid features.

Purchases are processed by Stripe or another payment provider. We do not store full card details.

Lux Credits are prepaid service credits used to access generation features. Lux Credits are not cash, are not a stored-value facility, are not transferable, and are not redeemable for money except where required by law.

Your use of Lux Credits, subscriptions, failed generation handling, refunds, renewals, top-ups, promotional credits, and expiry is governed by the Credit and Refund Policy.

10. Automatic Renewal

If you purchase a subscription, it may automatically renew until cancelled. The price, renewal period, and included credits will be shown at checkout or on the pricing page.

You can manage or cancel paid subscriptions through the available account or billing portal where supported. Cancelling a subscription stops future renewals but does not automatically refund the current billing period unless required by law or stated in the Credit and Refund Policy.

11. Changes to Prices and Features

We may change pricing, credit values, credit costs, included plan allowances, features, limits, models, generation tools, or availability from time to time.

If a change materially affects an active paid subscription, we will take reasonable steps to notify affected users where required by law.

12. Third-Party Services

The Service relies on third-party providers, which may include Supabase, Fal, Mux, Cloudinary, Stripe, Cloudflare, AI model providers, analytics tools, email providers, and hosting services.

Third-party services may fail, delay, change, suspend, reject content, or become unavailable. We are not responsible for third-party services except where required by law.

When you use third-party services through or in connection with Make it Lux, their own terms and privacy policies may also apply.

13. User Conduct and Security

You must not:

  • scrape, crawl, harvest, copy, or collect data from the Service without permission;
  • use bots, scripts, or automation to create accounts, upload files, redeem promo codes, bypass limits, or abuse the Service;
  • attack, probe, overload, disrupt, reverse engineer, or circumvent the Service;
  • misuse APIs, uploads, webhooks, generation queues, or payment systems;
  • share, resell, transfer, or misuse accounts, access tokens, promo codes, or Lux Credits;
  • interfere with other users or the public gallery.

We may monitor and limit usage to protect the Service.

14. Moderation, Suspension, and Termination

We may remove content, refuse generations, restrict public display, suspend features, withhold publishing, cancel or reverse promotional credits, suspend accounts, or terminate access if we reasonably believe:

  • you breached these Terms or our policies;
  • your content or activity creates legal, safety, security, payment, fraud, abuse, reputation, or operational risk;
  • required payment fails;
  • we are required or permitted to do so by law or a third-party provider.

You may stop using the Service at any time. You may request account deletion by contacting support@makeitlux.com.

Some obligations survive termination, including licences needed for previously public content, payment obligations, disclaimers, liability limitations, indemnities, and dispute terms.

15. Intellectual Property Complaints

If you believe content on Make it Lux infringes your copyright, trade mark, publicity, privacy, or other rights, contact support@makeitlux.com with:

  • your name and contact details;
  • the work, rights, or person you claim is affected;
  • the URL or description of the content;
  • a statement that you have a good-faith belief the use is not authorised;
  • a statement that your notice is accurate and that you are authorised to act.

We may remove or restrict content while reviewing a complaint.

16. Feedback

If you send us ideas, suggestions, feedback, or feature requests, we may use them without restriction or compensation to you.

17. Disclaimers

To the extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, perfect outputs, specific results, commercial success, platform approval, product accuracy, or that outputs will be free from errors or third-party claims.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under applicable law, including the Australian Consumer Law.

18. Liability

To the extent permitted by law, we are not liable for indirect, special, incidental, consequential, punitive, or exemplary loss, loss of profit, loss of revenue, loss of data, loss of goodwill, or business interruption arising from or related to the Service.

To the extent permitted by law, our aggregate liability for claims relating to the Service is limited to the greater of:

  • the amount you paid to Make it Lux in the three months before the event giving rise to the claim; or
  • AUD $100.

This limitation does not apply where liability cannot be limited by law.

19. Indemnity

To the extent permitted by law, you agree to indemnify us against losses, claims, damages, liabilities, costs, and expenses arising from:

  • Your Content;
  • your use of outputs;
  • your breach of these Terms;
  • your violation of law or third-party rights;
  • your misuse of the Service.

20. Governing Law

These Terms are governed by the laws of New South Wales, Australia, except where consumer law in your country requires otherwise.

You and Make it Lux submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

21. Changes to These Terms

We may update these Terms as the Service changes. We will post the updated version and update the "Last updated" date. If changes materially affect your rights or paid subscription, we will take reasonable steps to notify you where required by law.

Your continued use of the Service after changes take effect means you accept the updated Terms.
